Terms & Conditions

DesignXMM Real Estate Digital Staging Subscription Service

By subscribing to the DesignXMM Real Estate Digital Staging service (“Service”), you (“Client”) agree to the following Terms & Conditions. These terms ensure clear expectations and protect both parties.

Agreement Terms

1. Service Scope & Deliverables

• Client receives digitally staged images based on the selected subscription package (Essential Edge, Signature Suite, or Premiere Portfolio).

• Each package specifies the number of images per month and any additional features (e.g., 24-hour turnaround, priority service, or social media features).

• Final deliverables will be provided as high-resolution JPEG or PNG files.

• The scope is limited to interior spaces only unless otherwise specified.

• All designs are custom to the submitted property photos.

2. Turnaround Time

• Standard turnaround time: 3-5 business days after receipt of complete, high-quality property photos.

• Signature Suite or Premiere Portfolio clients may receive expedited services as outlined in their plan.

• Delays may occur if submitted photos do not meet quality standards, or if required information is incomplete.

3. Client Responsibilities

• Client is responsible for submitting accurate, high-quality, well-lit property photos.

• Photos must be in JPEG or PNG format and meet minimum resolution requirements (recommend 2000x1500px or higher).

• Any requested revisions are limited to cosmetic adjustments and do not include a complete redesign.

4. Usage Rights & Restrictions

• DesignXMM retains full ownership of all digital designs, staging assets, and intellectual property.

• Client is granted a limited, non-transferable license to use the staged images exclusively for marketing the specific property submitted.

• Images may not be reused, resold, redistributed, or altered beyond minor cropping/resizing without written consent from DesignXMM.

• Unauthorized use will result in immediate termination of service and may result in legal action.

5. Payment Terms & Subscription Policy

• Subscriptions are billed monthly and renew automatically unless canceled by the Client.

• Payment is due in full at the start of each billing cycle.

• Subscription cancellations require 30 days written notice prior to the next billing date.

• No refunds will be issued once work has commenced or after staged images are delivered.

6. Revisions Policy

• Each project includes one (1) round of minor revisions (e.g., furniture color, accessory adjustments).

• Additional revisions beyond the included round will incur an extra fee, quoted on a case-by-case basis.

• Full redesign requests will be treated as a new project and billed separately.

7. Limitation of Liability

• DesignXMM is not responsible for the sale, marketing performance, or financial outcome of any property using our staged images.

• Client agrees to hold DesignXMM harmless from any claims, damages, or liabilities arising from the use of the Service.

8. Confidentiality & Privacy

• Client information and property details will remain confidential.

• Property photos will not be shared publicly by DesignXMM without Client’s written permission (except where included in marketing for Luxe/Ultra Luxe packages with Client consent).

9. Termination of Service

• DesignXMM reserves the right to terminate the subscription if the Client breaches these Terms, engages in misuse, or fails to comply with usage rights.

• Any outstanding payments will still be due upon termination.

10. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles.
